by Tracy McCue, Sumner Newscow — On Monday, Sumner County Attorney Kerwin Spencer has added Class C misdemeanor adultery charges against Joshua Santana, the husband of Bobbi Santana, who was shot in a domestic dispute by Michaela Cliffman on the morning of Feb. 5, 2014. See story here.

Spencer charged Cliffman Friday afternoon with the adultery misdemeanor charge, after she was originally charged by the Wellington Police Department with aggravated battery, a felony.  Spencer said a Class C misdemeanor is considered slightly harsher than a traffic infraction but lighter than most misdemeanor charges.

The official public affidavit was released by the Sumner County District Court.

The court document report is as follows: 

” On Feb. 5, 2014 at about 5:10 a.m., Officers Dustin Helms and Keith Westmoreland, were dispatched to 806 South G in Wellington for a shooting. This is the residence of Dustin Repphan and Michaela Cliffman.

Cliffman is temporarily living there by herself since Repphan was currently in the county jail. Those present at the time were Michaela Cliffman, Joshua Santana, and Joshua’s wife, Bobbi Santana.

Bobbi Santana had been shot with the handgun that Michaela Cliffman had been holding. Joshua Santana had called 911 to report the shooting. Helms made contact with Joshua Santana, he observed Bobbi Santana on the floor with a gunshot wound. Michaela Cliffman was sitting on the coach.

Helms asked who the shooter was and Joshua pointed to Michaela. Helms handcuffed Michaela and took her to  his patrol car. Westmoreland asked Joshua what happened. Joshua stated he was separating from his wife Bobbi. He told Bobbi he was going to his brother’s house but instead came to Cliffman’s residence. He was in the bedroom with Michaela. A short time later, Bobbi was pounding on the front door demanding to be let in. He went to the door and Bobbi came inside and went into the bedroom where Michaela was and grabbed Michaela.

Joshua stated that Bobbi grabbed Michaela again and he was trying to separate the two again when the gun went off and Bobbi got shot. Joshua stated after Bobbi was shot he was “freaking out” trying to find his cellphone and eventually called 911. Helms talked to other officers and found out Bobbi was shot in the abdomen, on the left side with an exit wound on the right side.

He asked Bobbi what had happened. She said she came over to the residence and got into it with Michaela and Joshua separated them. They went into the living room and got into it again. As Joshua was separating the two again, Michaela shot her.

Helms took Michaela to the Wellington Police Department where she was interviewed by Detective Bobby Wilson. Michaela advised that she was living at the residence by herself while Dustin Repphan was in jail. She advised she and Joshua had written to Michaela which made Bobbi mad. Bobbi had come to her house on February 4 about 3:00 p.m. yelling at Michaela and accusing here of having sex with her husband and threatened to beat her ass.

She told Bobbi to leave which Bobbi did. Then between 11 p.m. and midnight, Josh showed up at her house. She fixed some Ramon noodles and then they had sex. Later, she heard Bobbi banging on the front door and said something about calling the cops. Josh got dressed and was going to leave with Bobbi, but Bobbi got past him and came into the bedroom. Bobbi pulled Michaela’s hair and Joshua tried to get Bobbi off of her.

Michaela had the gun but she dropped the gun on the floor, then she picked it up and fled to the living room. Joshua was trying to calm down Bobbi and get her to leave. She came to the living room and Bobbi came after her again and grabbed her hair. Josh was trying to get Bobbi off and Michaela fired the gun. She dropped the gun and Bobbi fell to the ground. Joshua called 911 and Michaela apologized to Bobbi for shooting her.

Complainant has determined that Michaela was acting in self-defense, so the Aggravated Battery charge has been withdrawn and only the Adultery charge is being filed at this time.”
