Jury trial of Sylvester Provencio accused of rape is continued for Dec. 13

by Tracy McCue, Sumner Newscow — A jury trial that was scheduled to begin this week involving Sylvester Provencio, 22, of Caldwell has been rescheduled for Dec. 13 at 9 a.m. in Sumner County District Court.

Provencio is charged with rape, an off-grid felony. He had pled not guilty during an arraignment held March 24 to a charge alleging that he raped a 13-year-old girl during a New Year’s Eve Party at the home of his parents in January.

Provencio has since been found guilty of reckless aggravated battery for an unrelated crime which involved an attack of two Caldwell men in August, 2015. He is currently serving a 31-month sentence.

A criminal complaint filed by the Sumner County Attorney’s office in February alleged Provencio engaged in sexual intercourse with a victim, who allegedly was “overcome by force or fear.”

Provencio is also facing four counts of furnishing alcohol to a minor, all misdemeanors.
