Sumner County Commissioner minutes: Aug. 9-10, Aug. 16-17

Sumner Newscow report — The following are the Sumner County Commissioner meeting notes for August 9-10 and 16-17. 

August 9, 2021 – 9 a.m.

The Board of County Commissioners met in regular session in the Commission Room of the Sumner County Courthouse.  Those present were Chairman Steve Warner, Commissioner Jim Newell and Commissioner John Cooney.  Also present was County Clerk Debra A. Norris. 

The Commission reviewed and unanimously approved the minutes of August 2 and 3.

Gilmore & Bell Counselor Mitch Walter along with Stifel Public Finance Company representative Steve Shogren, and County Counselor Jack Potucek met with the Commissioners to discuss a bond for road and bridge repairs in the County.  Also present were Road and Bridge Director Superintendent Doug Finch, Office Administrator Chris Carter, Office Manager Jenna Richman, and County Treasurer Dannetta Cook.  A prepared resolution was presented, authorizing the issuance of Road Bond 2021-1 and 2021-2.  The Commission reviewed the original $11,640,000 bonds issued in 2014. The prepared resolution, authorizing improvements related to General Obligation Bond (GOB) Series 2014-1.  

Shogren and Walter explained the projects, financing, and timing of the bond issue.  After review and discussion, the commission unanimously approved a resolution declaring it necessary to authorize the payment of the costs of improvements to existing roads and bridges in the County and providing for the issuance of general obligation bonds to pay the costs thereof, adopting Resolution 2021-12.

Counselor Potucek provided general reviews and updates.

The Commission reviewed and approved two payables reports in the amount of $2,268.40 and $110.00, respectfully.

There being no further business, the Board of County Commissioners adjourned at 11:22 a.m.

August 10, 2021 – 9 a.m.

The Board of County Commissioners met in regular session in the Commission Room of the Sumner County Courthouse.  Those present were Chairman Steve Warner, Commissioner Jim Newell, and Commissioner John Cooney.  Also present were County Clerk Debra A. Norris, County Counselor Jack Potucek, County Appraiser Cindy Magill, and Deputy County Clerk Diana Aufdengarten.  The meeting was opened with the Pledge of Allegiance.

The Commission discussed protocol for employees affected by the COVID virus.  Health Department Director Laura Rettig provided additional information on CDC requirements.  

Maintenance Director Joe Struble provided departmental updates.

Counselor Potucek provided general reviews and updates.

The Commission reviewed and approved mid-month payables in the amount of $506,189.15.

There being no further business, the Board of County Commissioners adjourned at 10:32. a.m.

August 16, 2021 – 9 a.m.

The Board of County Commissioners met in regular session in the Commission Room of the Sumner County Courthouse.  Those present were Chairman Steve Warner, Commissioner Jim Newell and Commissioner John Cooney.  Also present were Deputy County Clerk Diana Aufdengarten and 80th House Representative Bill Rhiley.  

The Commission reviewed and unanimously approved the minutes of August 9 and 10.

County Treasurer Dannetta Cook provided the amount distributed from the Kansas Star Casino was $145,340.10.

At 9:25 a.m., upon unanimous vote, the Commission entered into executive session for 3 minutes with County Counselor Jack Potucek for non-elected personnel.   Deputy Clerk Aufdengarten was also present.   At 9:28 a.m., the Commission reconvened in an open session.  No binding action was taken as a result of the executive session.

Planning and Zoning Director Jon Bristor met with the Commissioners and provided the current status of different cases/projects his department has been working.   

At 9:52 a.m., the Commission recessed to meet at the Raymond Frye Complex.

At 10:00 a.m., the Commission reconvened in an open session at the Raymond Frye Complex.

At 10:00 a.m., the Commission held a public hearing at the Raymond Frye Complex for Zoning Case No. 01PC-21, an application Sumner County Hospital District No 1 and Rachel Sproul CFO, Agent requesting a short form plat of one (1) Rural District tract for Subdivision to be known as Sumner County Hospital Addition (one tract containing 36.42 acres, more or less) for the purpose of a healthcare facility.  The application identifies the location as between W 175th St S and W 178th St S on the west side of Greene Rd, Caldwell, KS 67022.  Several persons were present however no one chose to speak.  The Planning Commission, with eight members present, unanimously recommended approval.  The Commission unanimously approved Zoning Case No. 01PC-21, adopting Resolution No. 2021-13.  

At 10:09 a.m., the Commission held a public hearing at the Raymond Frye Complex for Zoning Case No. 02PC-21, an application by Sumner County Hospital District No. 1 and Rachel Sproul CFO, Agent requesting a conditional use of one tract containing 36.42 acres, more or less for the purpose of a healthcare facility. The application identifies the location as between W 175th St S and W 178th St S on the west side of Greene Rd, Caldwell, KS 67022.  Several persons were present however no one chose to speak.  The Planning Commission, with eight members present, unanimously recommended approval, on condition the Construction of this project, shall follow the same procedures as outlined in the agreement with Sumner County and Sedgwick County, for commercial and industrial zoned tracts of land, i.e. follow all codes for construction.  The Commission unanimously approved Zoning Case No. 01PC-21, adopting Resolution No. 2021-14.

At 10:16 a.m., the Commission recessed to meet at the Commission chamber.

At 10:22 a.m., the Commission reconvened in open session in the Commission Chamber for business to come before them.

The Commission reviewed a bid received for properties located at 1811 and 1821 N Lincoln, Wellington.  After discussion, the Commission unanimously accepted the bid from Janice Olivas.  The Clerk’s office was authorized to contact Ms. Olivas and prepare the Quit Claim Deed.  

At 10:58 a.m., upon unanimous vote, the Commission entered into executive session for 10 minutes with E911 Director BJ Tracy to discuss non-elect personnel.  At 11:08 a.m., the Commissioners reconvened in an open session.  Chairman Warner advised no binding action was taken as a result of the executive session.

The Commission reviewed and unanimously approved payables in the amount of $4,003.63.

Counselor Potucek provided general reviews and updates.

There being no further business, the Board of County Commissioners adjourned at 11:45 a.m.

August 17, 2021 – 9 a.m.

The Board of County Commissioners met in regular session in the Commission Room of the Sumner County Courthouse.  Those present were Chairman Steve Warner, Commissioner Jim Newell, and Commissioner John Cooney.  Also present was Deputy County Clerk Diana Aufdengarten.  The meeting was opened with the Pledge of Allegiance.

Robin Ralls, Noxious Weeds Director, provided updates on Sumner Memorial Gardens. Director Ralls reviewed with the Commission her vision and plans she has for the upkeep and future maintenance of the cemetery.

County Attorney Larry Marczynski met with the Commissioners and discussed staffing levels as well as updates on the County Attorney’s office.  After discussion, the staffing level was changed to keep the summer temporary attorney on as a part-time employee.

At 10:52 a.m., upon unanimous vote, the Commission entered into executive session for 5 minutes with County Counselor Jack Potucek for an attorney/client privileged matter.   Deputy Clerk Aufdengarten was also present.   At 10:57 a.m., the Commission reconvened in an open session.  No binding action was taken as a result of the executive session.

Counselor Potucek provided general reviews and updates.

There being no further business, the Board of County Commissioners adjourned at 11 a.m.
