Sumner County Commissioner minutes: Nov. 29 – Nov. 30, 2021

Sumner Newscow report — The following are the Sumner County Commissioner meeting notes for Nov. 29 and Nov. 30.

November 29, 2021 – 9 a.m.

The Board of County Commissioners met in regular session in the Commission Room of the Sumner County Courthouse.  Those present were Chairman Steve Warner, Commissioner Jim Newell and Commissioner John Cooney.  Also present were County Clerk Debra Norris, 80th House Representative Bill Rhiley, and Citizen Leonard Rausch.

Mr. Rausch presented the Commission with a petition, containing approximately 100 signatures, concerning Zoning Cases 04PC-21 and 05PC-21.  The zoning cases are scheduled for Commission consideration on Tuesday, November 30 at 10 a.m.

The Commission reviewed and unanimously approved the minutes of November 22 and 23.

Representative Rhiley provided a legislative update, of the special session, to the Commission.

County Counselor Jack Potucek with Attorney Doug Pfalzgraf reviewed with the Commission the properties, unpaid taxes for 2015 and 2016, available in the tax sale, scheduled for November 30 at 10 a.m.  Also present were County Treasurer Dannetta Cook, Administrative Assistant Jennifer Helpingstine, Tax Clerk Sharon Moss, GIS Technician Deane Reyes and Clerk/Typist II Sarah Mercer.  At the beginning of the process, there were 255 parcels of property involved with 44 parcels remaining.  The Commission determined the county’s opening bid for each property.

Counselor Potucek provided general reviews and updates.

There being no further business, the Board of County Commissioners adjourned at 12:01 p.m.

November 30, 2021 – 9 a.m.

The Board of County Commissioners met in regular session in the Commission room of the Sumner County Courthouse.  Those present were Chairman Steve Warner, Commissioner Jim Newell and Commissioner John Cooney.  Also present was County Clerk Debra Norris and 80th House Representative Bill Rhiley.

At 9:03 a.m., upon unanimous vote, the Commission entered into executive session for 10 minutes to discuss non-elected personnel.  At 9:13 a.m., the Commission reconvened in open session.  Chairman Warner advised no binding action was taken as a result of the executive session.

Planning and Zoning Director Jon Bristor presented prepared resolutions for appointments to the Board of Appeals and Planning Commission.  Planning Commission Chairman Bruce Weber was also present.  After review and discussion, the Commission unanimously adopted Resolution No. 2021-22 and 2021-23, respectfully.

Director Bristor provided additional departmental updates.

At 9:54 a.m. the Commission recessed to Raymond Frye Complex.

At 10:02 a.m. the Commission reconvened in open session at the Raymond Frye Complex to hear two zoning cases.

 At 10:02 a.m., the Commission held a public hearing on two zoning cases, with Planning and Zoning Director Jon Bristor. Also present was Tiffany Clark, Agent for the application.

The first zoning case, No. 04PC-21, an application by On the Range Home Solutions, LLC, Randall, and Kelly Clark and Tiffany Clark, Agent, requesting a zoning change from “R-D” Rural District to “G-1” Recreation District, for the purpose of a wedding venue.  The location, in the Southeast corner of 80th Avenue and Seneca Road, contains 19.99 acres, more or less.  During public comments, several citizens spoke against the rezoning due to location, road conditions, water, and sewer, along with the rural lifestyle. The Planning Commission, with nine members present, recommended approval with a five yes to four no vote.  The Commission reviewed the information provided.  Chairman Warner feels it is not a good fit for the area and moved to deny the application.  After discussion, the Commission unanimously denied zoning Case No. 04PC-21.

The second zoning case heard, No. 05PC-21, an application by On the Range Home Solutions, LLC, Randall and Kelly Clark and Tiffany Clark, Agent, requesting a conditional use for a wedding venue.  The location, in the Southeast corner of 80th Avenue and Seneca Road contains 19.99 acres, more or less.  During public comments, a few citizens again spoke against the conditional use request.  The Planning Commission, with nine members present, recommended approval, with a five yes and four no vote.  After review and discussion, the Commission unanimously denied Zoning Case No. 05PC-21.

At 11:14 a.m. the Commission recessed to return to the Commission Chambers.

At 11:22 a.m. the Commission reconvened in open session in the Commission Chambers to hear other business brought before them.

Health Department Director Laura Rettig provided an updated job description for the dietitian position for the Health Department.  After review, the Commission unanimously approved the updated job description.  Director Rettig advised she would begin the search for personnel.

A new grant was presented to the Commission for review, allowing for one-time additional pay for staff at the Health Department.  The grant provides funding to COVID-related personnel.

County Counselor Jack Potucek provided general reviews and updates.

The Commission reviewed and unanimously approved prior-year abatement orders in the amount of $438,782.56.

There being no further business, the Board of County Commissioners adjourned at 11:54 a.m.
