Sumner County Court Docket: Filings of the past month

by Tracy McCue, Sumner Newscow — The following are charges recently filed at Sumner County District Court in Wellington for the past month:

A “furnishing alcohol to a minor” affidavit was recently filed by Alcoholic Beverage Control Agent Joseph Garman at the courthouse for the Liquor Locker business located at 124 S. Chisholm St. in Caldwell.

On December 22, 2011 at 1:57 p.m., Alcoholic Beverage Control Agents Jim Fay and Garman conducted an alcohol compliance check with the use of an underage cooperating individual, noted in this investigation as UCI 631, who was 18 years of age with the birth date of 1993 and will not be 21 until 2014. 

UCI 631 had a legal Kansas driver’s license and was instructed to answer honestly if asked his/her age or date of birth by an employee of the liquor establishment as a condition to purchasing liquor, according to the affidavit.

UCI 631 was given a $20 bill to purchase alcohol.

According to the affidavit, UCI 631 entered the Liquor Locker and exited carrying a six-pack of Bud Light cans. UCI 631 returned to the state vehicle that was parked near the front door and advised that a white male clerk had checked the driver’s license and still sold UCI the six pack for $6.50 returning $13.50 in change.

Garman said he went into the store and spoke to the clerk, who was Brian Willis, the owner, and informed him that he had sold alcohol to an 18-year-old UCL. He said Willis checked the ID that showed him it had the green stripe that said he turned 18 on Sept. 25, 2011.

The owner was then issued a citation.

Susan Pottorff, born in 1965, of Wellington has been charged with unlawful possession of Alprazolam, and unlawful possession of Diazepam. Both charges are Class A misdemeanor.

Brandon O’Neal, born in 1993, of Conway Springs, has been charged with burglary, theft and criminal damage to property of the residence of James Dugan at 876 W. 120th Ave., Conway Springs

O’Neal allegedly obtained unauthorized control over property of value of at least $25,000 but less than $100,000 including guns, jeweler, computers, a video camera, cash, a saxophone, and an iPod.

O’Neal also allegedly damaged or substantially impaired the use of property to the extent of at least $1,000, but less than $25,000 including a door and door jamb.

His charges of burglary and theft are level 7 felony charges. Criminal damage is a level 9 felony.

Danny Dry, born in 1967, of Wellington is charged with improper tag illumination, driving while suspended, unlawful possession of Hydrocodone, unlawful possession of Alprazolam; and unlawful possession of Diazepam.

Four of those charges are misdemeanors. The charge of possessing Hydrocodone, a narcotic drug, is a level 4 drug felony.

Ayla Hart, born in 1991, of Roanoke, La. has been charged with theft of a mirror owned by Barbara Knowles, a Class A nonperson misdemeanor.

Hart has also been charged with possession of marijuana while transporting in a vehicle, a Class A misdemeanor.

Dale Dalbom, born in 1980, of Viola, was charged with burglary of a non-dwelling residence, a level 7 felony. He allegedly entered into a building, manufactured home, mobile home, tent or other structure which is not a dwelling at 1225 N. Drury Road, Clearwater with intent to commit a felony, theft or sexual battery therein.

Zachary Conrad, born in 1991, of Wellington was charged with burglary of a non-dwelling, criminal trespass and theft for allegedly breaking into the Wellington landfill at 320 South West Road in Sumner County and stealing automotive batteries from Nathan Nuss, valued less than $1,000.

The burglary charge is a level 7 felony, while the trespass and theft charges are misdemeanors.

Tyler Norris, born in 1986, was charged with furnishing alcoholic liquor to an underage adult, a Class B Misdemeanor.

David P.J. Contreras-Vega, born in 1992, of Caldwell was charged with unlawful abuse of toxic vapors, i.e. ethyl alcohol with intent of causing a condition of euphoria, excitement, exhilaration, stupefaction or dulled senses of the nervous system which is a Class B non-person misdemeanor.

Tom D. Bell, Jr., born in 1959, of Wichita was charged with two counts of theft, class A nonperson misdemeanors.

Bell allegedly took two Sanyo brand 42-inch television sets from Wellington Wal-Mart. He also allegedly took a checkbook.

Samuel King, born in 1982, of Belle Plaine was charged with domestic battery for grabbing a person he lives with around the neck and restraining her in a rude and angry manner. The charge is a Class B misdemeanor.

Dale Church, born in 1938, of Wellington was charged with domestic battery, a class B misdemeanor, for knowingly causing physical contact with a woman he lives with on her upper body and arms in a rude and angry manner.

Church is also charged with violation of a protective order to refrain from having any direct or indirect contact with the same person.

Robert Bakert, born in 1977, of Marshall, Mo. was charged with possession of methamphetamine, a level four drug felony.

Casey Weir, born in 1982, of Wellington, was charged with interference with law enforcement. Weir allegedly on Sept. 22, 2012, physically resisted Wellington Police officer David VanDyke from the bar crowd during an alleged bar brawl, for which Weir was a possible suspect according to the complaint. Weir thus allegedly prevented him from trying to restore order, secure the peace and investigate the facts of the event. He is charged with a Class A nonperson misdemeanor.

Weir was also charged with unlawful possession of the depressant Alprazolam which is a Class A misdemeanor.

June Case, born in 1972, was charged with domestic battery of a person with whom the offender resides, a Class A misdemeanor. Case was also charged with criminal damage to property of less than $1,000 to a Dodge Durango of the same person. That charge is a Class B misdemeanor.

The following are charges stemming from an alleged incident on August 29, 2012 at the 121 E. Walnut Street in Argonia:

Zachary Foulk, born in 1989, of Argonia was charged with possession of marijuana, and two counts of possession of drug paraphernalia, all Class A misdemeanors.

Dale Cole, born in 1963, of Argonia was charged with possession of marijuana and two counts possession of drug paraphernalia, Class A misdemeanors. Cole was also charged with possession of methamphetamine a level 4 drug felony.

Alyssa Tucker, born in 1991, of Argonia was charged with possession of marijuana, and two counts of possession of drug paraphernalia.

Christopher Thomas Shapley, born in 1984, of Wellington was charged with burglary of a motor vehicle, a level 9 felony; theft, a Class A misdemeanor; and obstructing prosecution, a level 8 felony.

Shapley allegedly transported in his vehicle a girl to the location of another girl’s white Chevrolet pickup truck, waited for her while she entered the second girl’s vehicle without authority, and allegedly took the second girls’ purse without permission and with the intent to permanently deprive the second girl of the contents. Shapley then transported the first girl away from the area.

Joshua Koester, born in 1978, of Mulvane was charged with domestic battery of a person he is living with, a Class B misdemeanor.

Major McLemore, born in 1971, of Wichita was charged with with aggravated battery, a felony, to David Simmons. The complaint lists five alternative charges for one count of aggravated battery including severity levels of 4, 7, 7, 5, and 8.

Craig McBroom, born in 1961, of Wichita was charged with possession of methamphetamine, a level 4 drug felony and possession of drug paraphernalia.

Richard Clarke, born in 1961, of Haysville was charged with driving under the influence with a blood content of .08 or more, his fourth or subsequent conviction in his lifetime, which requires a mandatory 90 days in jail and serve 90 days before granting probation.

Clarke was also charged with failing to submit to a blood test while having three or more DUI convictions on or after July 1.

Those convictions were:

Sumner County – January 2004

El Dorado – December 2004

Sedgwick County – November 2007

Sedgwick County – February 2008.

Clarke was also charged with driving while license was suspended or revoked; and transporting an open container. The first two charges are felonies, the last two charges are misdemeanors.

Hector Ortega, born in 1992, of Wichita, was charged with possession of drug paraphernalia and possession of marijuana while transporting in a vehicle, both Class A misdemeanors. He was stopped for a defective tail lamp.

Wade Hlad, born in 1991, of Oxford was charged with driving while suspended, unlawful registration, possession of marijuana while transporting in a vehicle, possession of drug paraphernalia. All are misdemeanors. He was stopped for failing to use headlights.

Jason Johnson, born in 1975, of Conway Springs is charged with domestic battery after knowingly causing physical contact with a person for whom the offender resides; and another domestic battery charge. Both are Class A misdemeanors. Johnson has had a prior conviction in Clearwater Municipal Court to include jail for 90 days to one year, a fine of $500 to $1,000, five days of minimum mandatory incarceration, and work release allowable after 48 consecutive hours in jail.

Marvin Leonard, born in 1943, of Wellington is charged with aggravated indecent liberties with a child, a level 3 felony. Leonard is charged with unlawfully, feloniously and willfully fondling or touching a child with intent to arouse or satisfy the sexual desires of child under 14 years of age and not the spouse of the defendant.
