Sumner County Court Docket: Jan. 15, 2014 report
by Tracy McCue, Sumner Newscow — The following are two lists coming from the Sumner County District Court office.
The first list is “Court Complaint Filings” which are criminal court complaints recently filed by the Sumner County Attorney’s office. These are formal charges introduced into the Sumner County District Court system. The suspects listed in the complaint have not been tried by a judge or jury. All citizens are innocent until proven guilty in a court of law.
The second list is of recent convictions made at Sumner County District court cases where a verdict has been rendered by a Sumner County judge or jury.

LIST NO. 1 – CRIMINAL COMPLAINT FILINGS:
Kanisha Hamilton, born in 1988, of Oklahoma City, Okla. was charged with interference with law enforcement, a level 9 felony; possession of drug paraphernalia, a Class A misdemeanor; battery of a law enforcement officer, a Class A misdemeanor; and obstructing official duty, a level 9 felony.
Hamilton is accused of reporting to a Caldwell police officer false information about a relative bringing her to Caldwell and some men assaulting her. Earlier she allegedly told a nurse that a group of men including the relative had sexually assaulted her.
Hamilton also allegedly had rolling papers with intent to smoke controlled substances. She then allegedly kicked a Caldwell police officer and physically resisted being arrested and handcuffed for falsely reporting a crime.

Brittany Myers, born in 1988, of Wellington was charged with possession of hydrocodone, a level 5 drug felony; and unlawful use of nondriver’s identification, a Class B misdemeanor.
Myers is accused of having hydrocodone in her left front pocket on Dec. 19 at the Kansas Star Casino. She also produced a fictitious Kansas paper I.D. purporting to be another person.
Her court deposition is set for Jan. 16, 2014.

Wendy Gail Johnson, born in 1961, of Wellington was charged with possession of marijuana, a Class A misdemeanor; use of possession of drug paraphernalia, a Class A misdemeanor; and criminal carrying of a weapon, a Class A misdemeanor.
On Dec. 20, 2013, Johnson is accused of having marijuana and a glass smoking pipe located in her jeans pocket. She also was carrying a handgun covered up by her shirt and did so when she was not on her land, abode or fixed place of business.
Her court deposition is set for Jan. 23, 2014.

Zachariah Brown, born in 1985, of Wellington was charged with criminal damage to property, a Class B misdemeanor; and aggravated battery, a level 7 felony.
Brown is accused of knocking the passenger side mirror off of another’s car, doing an estimated damage of $100. Brown allegedly was upset because his car was stuck and threatened two females that if they followed him into the house he would cut or stab them.
He then allegedly cut the hand of one of those females with a knife when the alleged victim reached inside the door to try to unlock it which caused a laceration to her hand.
Brown’s court deposition is set for Jan. 16, 2014.

David Depperschmidt, born in 1960, of Bel Aire was charged with theft, a Class A misdemeanor.
Depperschmidt is accused of taking about $400 in cash from the wallet of another person.

Jason Michael Stallings, born in 1977, of Wellington was charged with three counts of sale of less than 1.0 grams of methamphetamine within 1,000 feet of a school, a level 3 drug felony; conspiracy to distribute methamphetamine within 1,000 feet of school in a quantity greater than 1.0 grams but less than 3.5 grams, a level 2 drug felony; possession with intent to distribute more than 3.5 grams of methamphetamine within 1,000 feet of school, a level 1 drug felony; and possession of drug paraphernalia to distribute a controlled substance, a level 5 drug felony.
On Oct. 13, 2013 at the Wellington Steakhouse Motel which is less than 1,000 feet from the Wellington High School, Stallings is accused of distributing less than 1.0 grams methamphetamine to an informant for $25. Then on Oct. 15 at 9 p.m. at the same motel, Stallings is accused of selling .07 grams of meth for $25 to an informant. Then five minute later sold .07 grams of meth to a confidential informant for another $25.
On Oct. 14 through Oct. 16, Stallings and another person agreed together to commit or to assist in committing the distributing of 1.0 grams but less that 3.5 grams of meth. The second person arranged the drug sale with a confidential informant and he showed up and purchased .07 grams for $50 and was advised they had two grams they were selling in quarter gram lots in another room.
On Oct. 16, Stallings is accused of having a large quantity of meth in another room at the Wellington Steakhouse Motel and a quantity of about 5.0 grams with part of it being for sale and part of it for personal use.
Stallings allegedly on Oct. 16 in the motel possessed about 5.4 grams of meth in a packaged weight within the room when searched by a community corrections officer along with scales and packaging supplies. Also, allegedly found in the room were small spoons, nine empty bags marked “25”, one bag of meth marked “50”, one bag of meth marked “35”, two bags of meth marked “30” three bags of meth marked “25” and a set of scales.

Miki Hubbard, born in 1992, of Mulvane was charged with domestic battery, a Class B misdemeanor; and disorderly conduct, a Class C misdemeanor.
Hubbard is accused striking her boyfriend in the face and injuring his nose.
Hubbard’s court deposition is scheduled for Jan. 23, 2014.

Greggory Norris, born in 1975, of Blackwell, Okla. was charged with forgery, a level 8 felony; and theft, a Class A misdemeanor.
Norris is accused of feloniously altering a check in the amount of $2,800 to a payee for a $2,000 debt and requesting a refund of $800 for overpayment.
His court deposition is set for Jan. 23, 2014.

Kristopher Shell, born in 1989 of Wellington was charged with theft, a Class A misdemeanor.
On April 26, 2013 Shell is accused of taking Wal-Mart merchandise including a HP 2000 Laptop computer, Gateway Laptop computer; earphones, and a XBox 360 game console; with intent to deprive the owner permanently of the possession having a value less than $1,000.

Long Ngoc Nguymen, born in 1974, of Wichita was charged with criminal trespass, a Class B misdemeanor; and interference with a law enforcement, a Class B misdemeanor.
Nguymen is accused of entering the Kansas Star Casino on Dec. 15, 2013 when he was not authorized to because he was on the self-exclusion list from entering.
He was allegedly asked to show his identification which he said he had none when he had his driver’s license and passport on him.
His court deposition is set for Jan. 16, 2014.

Robert Vandyke, born in 1948, of Derby, was charged with theft of lost or mislaid property, a Class A misdemeanor.
Vandyke is accused of obtaining control of a wallet of $85 an alleged victim dropped on the casino floor. He allegedly took the cash and left the wallet without reporting it was lost to anyone before walking out of the Kansas Star Casino.
His court deposition is set for Jan. 30, 2014.

Michael Turner, born in 1970, of Belle Plaine was charged with domestic battery, a Class B misdemeanor; criminal restraint, a Class A misdemeanor; disorderly conduct, a Class C misdemeanor; and no driver’s license, a Class C misdemeanor.
Turner is accused of grabbing a woman around the neck and then forcing her down on the couch to listen about his angry lecture about spilled milk. He then is accused of leaving and driving on a public road in the 1400 block of East 90th Avenue without having a driver’s license in his possession.
His court deposition is set for Feb. 6, 2014.

Elautua Coleman, born in 1988, of Wichita was charged with theft, a Class A misdemeanor.
Coleman was charged on Jan. 1, 2014 at the Kansas Star Casino of obtaining control of a purse and cash from a woman who had a purse on the floor beside her while playing a slot machine.
Coleman’s court deposition is set for Jan. 30, 2013.

Timothy Bickerstaff, born in 1980, of Wellington was charged with speeding, a traffic infraction; improper registration, a misdemeanor; transport of open container, a misdemeanor; possession of marijuana, a Class A misdemeanor; possession of drug paraphernalia, a Class A misdemeanor.
Bickerstaff is accused of speeding 78 mph in a 65 mph zone, not having proper registration, having an open container of alcohol, having marijuana in a small pill bottle inside a Crown Royal bag, and a metal grinder.
Bickerstaff’s court deposition is set for Jan. 16, 2014.

Eric Johnson, born on December 19, of Haysville was charged with transporting an open container, a misdemeanor; possession of marijuana, a Class A misdemeanor; and possession of drug paraphernalia, a Class A misdemeanor.
On Dec. 19, 2013, Johnson is accused of transporting a half full bottle of Coors beer, and a chrome smoking pipe with marijuana inside.
Johnson’s court deposition is set for Jan. 23, 2014.

Victoria Bell, born in 1977, of Wichita was charged with theft, a level 9 felony of over $1,000 but less than $25,000.
Bell is accused of taking a wallet containing $1,200 in cash belonging to another person.

Desiree Maxfield, born in 1974, of Mulvane was charged with domestic battery, a Class B misdemeanor; and disorderly conduct, a Class C misdemeanor.
Maxfield is accused on April 22, 2013, of angrily slapping and scratching a household member causing him to bleed and then using abusive language which escalated into a physical altercation.
Maxfield’s court deposition is set for Jan. 16, 2014.

Kendall Carter Roberson, born in 1994, of Wellington was charged with battery, a Class B misdemeanor; disorderly conduct, a Class C misdemeanor; and consumption of alcohol by minor, a Class C misdemeanor and 30-day driver license suspension.
Roberson was accused of repeatedly punching another individual in the face because he was mad at him. He also allegedly called this person names and invited him to fight with him.
Roberson was then arrested after allegedly admitting that he had been drinking both hard liquor and beer shortly before the fight.
Roberson’s court deposition is set for Feb. 6, 2014.

Stetson Schmidt, born in 1993, of Belle Plaine was charged with burglary of a non-dwelling, a level 7 felony; and possession of drug paraphernalia, a Class A misdemeanor.
Schmidt is accused of entering a barn at 384 East 140th St. in South Haven and obtaining a wrench, sander, and battery with intent of depriving the owner of possession valued at less than $1,000. He allegedly personally stole the wrench and aided and abetted Justin Goans in stealing the sander and battery by providing him transportation to and from the crime scene.

Dylan Hay, born in 1989, of Wellington was charged with possession of marijuana, a Class A misdemeanor; and interference with law enforcement officer, a Class A misdemeanor.
Hay is accused to possessing loose marijuana in the kitchen of the apartment and additional marijuana in his pocket. A Wellington police officer was investigating a possible stabbing at Hay’s girlfriend’s apartment and possession of marijuana in the kitchen when Hay allegedly ran and the officer had to pursue him on foot and use force to compel him to stop.

LIST NO. 2 -Recent convictions at Sumner County District Court
Anthony Patton, born in 1978, of Wichita pled guilty to fraudulent use of a driver’s license of ID Card, a Class B misdemeanor; and possession of drug paraphernalia, a Class A misdemeanor. Patton is sentenced to six months in county jail with one year probation, and fined $350 a court costs for both crimes to be served concurrently. The possession of cocaine charge was dismissed.
Patton was accused of presenting a fraudulent driver’s license at the Kansas Star Casino and having possessed cocaine in his pocket on Dec. 14, 2013.

Michael Zollinger, born in 1982, of Wichita was found guilty by a Sumner County jury on January 7, 2014 of the following charges:
•unlawfully possessing methamphetamine;
•possessing a small clear plastic bag used as drug paraphernalia;
•criminally carrying a weapon;
•possession of methamphetamine, without Kansas tax stamp affixed.
Zollinger was found not guilty of possessing a glass pipe.
Zollinger was accused on Jan. 3, 2013, of possessing a narcotic drug; a glass pipe and bag containing white powder used to ingest, inject or inhale into body; a firearm on his right hip he was not authorized to carry, and not having paid a tax on substances he was carrying.
His sentencing has been set for Feb. 27, 2014.

Justin Goings, born in 1980, of Wellington pled no contest and was found guilty to telephone harassment, a Class A misdemeanor. His charge of false impersonation was dismissed.
Goings is sentenced to six months in county jail with one year probation, court costs and court appointed attorney fees of $984.
Goings was accused of misrepresented himself when he called a woman at north F St. in Wellington stating that he was an officer of the court and legal counsel of another person. He allegedly left the false impression that he was an attorney when in reality he had no license to practice law in Kansas.
He then is accused of using his wife’s cell phone and a *67 call blocking feature to make another call with “intent to abuse, threaten or harass any person on the receiving end,” the complaint said.
Goings allegedly claimed to the alleged vicim that he was legal counsel for another person and she was in violation of parental custody documents and she could be arrested. Goings allegedly said he was an “officer of the court” and although she could be in serious trouble he would let her off with a warning this time.
As part of the probation conditions, Goings is to have no contact with three individuals, a psychological evaluation and/or anger control counseling at a CSO’s discretion and a work out payment schedule with CSO to include reimbursement for attorney fees.
