Sumner County Court Docket: March 25, 2014 report

by Tracy McCue, Sumner Newscow — The following are a list of criminal court complaints recently filed by the Sumner County Attorney’s office.

These are formal charges introduced into the Sumner County District Court system. The suspects listed in the complaint have not been tried by a judge or jury. All citizens are innocent until proven guilty in a court of law.

Martin Fitzwater, born in 1961, of Belle Plaine was charged with possession of methamphetamine, a level 5 drug felony; possession of drug paraphernalia, a Class A misdemeanor; and theft, a Class A misdemeanor.

Fitzwater is accused of having a baggie of meth in his pocket when he was arrested driving a vehicle. It was later discovered, he also allegedly had a trailer he was towing behind his truck which belonged to someone else. The complaint said he had no intention of returning the trailer to the rightful owner.

His court deposition is set for March 27.

Kieferro Hughes, born in 1988, of Wichita was charged with aggravated failure to appear, a level 10 felony.

Hughes is accused of failing to turn himself in within 30 days after being released on bond for charges of felony robbery, felony theft, and conspiracy to commit felony theft in Sumner County.

Hughes’ preliminary hearing is set for March 27.

Brian Mashburn, born in 1977, of Wellington was charged with domestic battery, his second offense, a Class A misdemeanor.

Mashburn is accused of causing bodily harm to a family or household member by angrily striking a female and pulling her hair. The complaint said that caused her to have black eyes and loss of hair.

Mashburn’s court deposition is set for March 27, 2014.

Lisa Shanahan, born in 1978, of Haysville was charged with interference of law enforcement, a level 8 felony; possession of methamphetamine with intent to distribute at least 3.5 grams, a level 2 drug felony; and possession of drug paraphernalia, a Class A misdemeanor.

Shanahan is accused of falsely identifying herself to a law enforcement officer in order to keep him from discovering she had an active arrest warrant for a felony probation violation for possession of stolen property in Sedgwick County.

She also allegedly possessed about 7 grams of methamphetamine on her and had a digital scale in her purse. Shanahan also allegedly possessed a meth pipe.

Shanahan’s deposition is set for April 3.

Christopher Wohler, born in 1982, of Wichita was charged with violation of protective order, a Class A misdemeanor; and criminal damage to property, a Class B misdemeanor.

Wohler is accused with violating a protection from abuse order issued on June 20, 2013 in Sedgwick County which prohibits him from contacting a person living at 1818 North C in Wellington. He allegedly used a knife to puncture the driver’s front tire causing the tire to go flat. The cost to repair or replace the tire is $125.

Wohler’s court deposition is set for April 17.

Brad D. Ahearn, born in 1981, of Haysville, was charged with unlawful use of financial card, a Level 9 felony; theft, a level 9 felony; and interference with law enforcement, a level 8 felony.

Ahearn is accused of falsifying, altering or using a non-existent financial card by inserting multiple false players club cards into slot machines including one belonging to another person. Ahern allegedly used $2,750 in “free” slot play to obtain cash vouchers for $2,880 at the Kansas Star Casino on March 1, 2014.

He is also accused of using multiple false identification casino cards to obtain free play of at least $2,750 which he played and converted to cash vouchers of $2,840. Allegedly, Ahearn physically resisted a Kansas Racing and Gaming Agent, who was making the arrest.

Ahearn’s first appearance in court is set for April 3, 2014.

Christopher Williams, born in 1988, of Flower Mound, Texas, was charged with possessing marijuana of more than 28 grams without attaching a drug stamp, a level 10 felony; possession of drug paraphernalia, a Class A misdemeanor; and transportation of open container, a misdemeanor.

Williams is accused of possessing more than 28 grams of marijuana and failing to have proper drug tax stamps to several black, plastic canisters in his vehicle. He also allegedly had several multicolored glass pipes with burnt residue and an open container of alcohol in the vehicle when apprehended on March 14.

His court deposition is set for April 3.

Wendy Zirkle, born in 1969, of Caldwell was charged with domestic battery, a Class B misdemeanor; and criminal threat, a level 9 felony.

Zirkle is accused of angrily slapping her boyfriend during an argument while threatening to kill him.

Braden Jones, born in 1987, of Wellington was charged with interference with law enforcement, a Class A misdemeanor; no driver’s license in possession, a misdemeanor; possession of methamphetamine of at least 1 gram but less than 3.5 grams with intent to distribute, a level 4 drug felony; possession of marijuana, a Class A misdemeanor; and possession of drug paraphernalia, a Class A misdemeanor.

Jones is accused of on March 19, 2014, of falsely reporting to a law enforcement officer that the name of his passenger was “Jeff” knowing that such information was false instead of revealing the passenger’s true name to be Daniel Gressel so Gressel would not be arrested for an outstanding arrest warrant from Wellington Municipal Court.

When asked for driver’s license, Jones allegedly could only produce an expired one. Upon search of the vehicle, officers allegedly found methamphetamine in a quantity at least 1 gram but less than 3.5 grams. Jones allegedly had the meth stored in a black zipper pouch in his vehicle containing a medium sized bag and several other plastic bags. He is also accused of having marijuana and a glass meth pipe.

His court deposition is set for March 27, 2013.
