Sumner County Court Docket: Thursday, Aug. 7, 2014

by Tracy McCue, Sumner Newscow — The following are a list of criminal court complaints recently filed by the Sumner County Attorney’s office.

These are formal charges introduced into the Sumner County District Court system. The suspects listed in the complaint have not been tried by a judge or jury. All citizens are innocent until proven guilty in a court of law.

Jill Wineinger, born in 1982, of Arkansas City was charged with failure to illuminate tag, a traffic infraction; possession of marijuana, a Class A misdemeanor; failure to provide proof of insurance, a Class B misdemeanor; and possession of drug paraphernalia, a Class A misdemeanor.

Wineinger is accused on June 29, 2014 of operating a vehicle between sunset and sunrise without a working tag light. When stopped, she allegedly had a baggy of marijuana in a pink bag and a red and blue glass smoking pipe in her car. She also allegedly failed to provide insurance. During the stop, David Gragg, born in 1983, of Arkansas City was charged with possession of narcotics, a level 5 drug felony; possession of marijuana, a Class A misdemeanor; and possession of drug paraphernalia, a Class A misdemeanor.

Gragg is accused of possessing five hydromorphone pills in his backpack which is a narcotic analgesic. He also allegedly had a bag of marijuana in his backpack and a multi-colored glass smoking pipe.

Jonathan Furman, born in 1986, of South Haven was charged with possession of drug paraphernalia, a Class A misdemeanor.

Furman is accused on Dec. 31, 2013 of possessing a glass marijuana pipe in his pocket.

Harry Arterburn, born in 1955, of Caldwell was charged and found guilty with disorderly conduct, a Class C misdemeanor.

Arterburn was accused on June 27, 2014 of engaging in noisy conduct by shooting 20 rounds from an SKS rifle within the city limits of Caldwell at 817 W. Avenue F.

Arterburn pled guilty and was sentenced on July 17 to five days in county jail and fined $100 court cost. His jail time was suspended upon payment of the fine and costs paid by Aug. 7 at 9 a.m. Probation was denied.

Marcus Peters, born in Oxford, was charged with three counts of burglary of a dwelling, a level 7 felony; theft, a Class A misdemeanor; and theft, a level 9 felony.

Peters is accused on June 9 and on June 28 of entering a dwelling at 125 N. Mill Road in Oxford with intent to commit a theft. He then allegedly obtained control of an autographed K-State football, flashlight, and soldering gun, all valued under $1,000.

Then Peters alleged entered the residence at 1360 50th Ave. in Belle Plaine with intent to commit a theft which including oars, propane bottle, Cours bar light, pellet rifle, charcoal grill, fishing poles, machete and other property valid at about $2,150.

John Buttry, born in 1985, of Wichita was charged with failure to comply with offender registration act, a level 6 felony; aggravated sexual battery, a level 5 person felony; and criminal restraint, Class A person misdemeanor.

Buttry is accused on March 22, 2014 to April 30, 2014 of having indecent liberties with a child which qualified him as an offender which mandates registration and reporting pursuant to the Kansas Offender Registration Act for a period of 25 years. He failed to notify the registering law enforcement agency, which is the Sumner County Sheriff’s Office within three business days following his change of residency location. Buttry allegedly moved from 318 W. Walnut Street in Argonia to 2338 South St. Francis in Wichita on March 26 and falsely stating he still lived in Argonia.

Then on April 11, 2014, Buttry allegedly returned to 318 W. Walnut in Argonia and touched a woman who was older than 16, before getting on top of her on a couch on two different occasions when she told him no both times.

Kayla Bennett-Hester, born in 1986, of Calbot Ark. was charged with possession of marijuana, a Class A misdemeanor; possession of marijuana with intent to distribute more than 450 grams but less than 2 kilograms, a level 2 drug felony and possession of drug paraphernalia with intent to distribute

Bennett-Hester is accused on June 23 of possessing a marijuana joint and a clear bottle containing unburnt marijuana in the console of her car. She is also accused of having a quantity of about 450 grams but less than two kilograms of marijuana in two camouflage duffle bags in the trunk of her car. This equated to 12 one pound plastic bags of marijuana.

Dustin Toothman, born in 1988, of Wellington was charged with possession of marijuana, a Class A misdemeanor; and possession of drug paraphernalia, a Class A misdemeanor.

Toothman is accused of having a baggy of marijuana in his room when a search warrant was served for his residence on March 1, 2014.

Erik Riddle, born in 1996, of Caldwell was charged with criminal damage to property, a Class A misdemeanor; possession of alcohol by a minor, a Class C misdemeanor; and littering, a Class C misdemeanor.

Riddle is accused of damaging a school door window by throwing a partially filled beer bottle through the window and breaking it.

James Whitehead, born in 1948, of Wichita was charged with theft, a Class A misdemeanor.

Whitehad is accused of stealing $260 out of a wallet and discarding it rather than taking the wallet and cash to lost and found.

Andrew Fleming, born in 1983, of Wichita was charged with burglary of a non-dwelling, a level 7 felony; criminal damage to property, a Class B misdemeanor; burglary of a dwelling, a level 7 felony; theft, a level 9 felony; and criminal damage to property, a Class B misdemeanor.

Fleming is accused on January 12, 2014 of breaking a glass door window and entering an out-building at 1829 W. 120th Ave., north of Milton with intent to commit a felony or theft. Allegedly, Fleming and another person broke into the building searching through it looking for something to steal. The owners then saw them allegedly getting into a GMC Yukon Denali and leaving the premises.

The blood of the other person was recovered near the broken glass door.

Then on January 14, 2014, at 845 N. Argonia Road in Milton, about four miles away from the first residence, Fleming is accused of breaking into a home. He allegedly stole a .22 Stainless Steel Derringer, 42-inch flat screen TV, Kenwood Receiver, four speakers, Eagle and Wolf folding knives, orbital saw, Campbell Nausfield stapler and nailer, Samsung DVD player, H&R .22 pistol, Henry .419 shotgun, Henry .22 rifle, and assorted other firearms all valued more than $1,000 but less than $25,000.

Fleming allegedly broke into the second residence by kicking in the front door and door jam which is valued less than $1,000.
