Sumner Court Docket: August 30, 2018 report

These are formal charges introduced into the Sumner County District Court system. The suspects listed in the complaint have not been tried by a judge or jury unless specified otherwise. All citizens are innocent until proven guilty in a court of law.

State of Kansas v. David Ray Edwards — Case No: 18 CR 173

Date of birth: 1966. Address: Caldwell.

Date of alleged crime: June 30, 2018.

Charges:

Count 1: Battery of law enforcement officer, Class A misdemeanor.

Count 2: Interference with law enforcement, Class A misdemeanor.

Count 3: Interference with law enforcement, Class A misdemeanor.

Count 4: Interference with law enforcement, Class A misdemeanor.

Count 5: Escape from custody, Class A misdemeanor.

Case description: Edwards is accused of kicking a Sumner County deputy in his right thigh. He also allegedly refused to identify himself when asked, give the deputy his wallet, or cooperate when being handcuffed. He allegedly got out of the police vehicle in transit, ran and hid in some bushes on the side of a residence in the 100 block of North Wichita Street in Caldwell.

State of Kansas v. David Fogle — Case No: 18 CR 174

Date of birth: 1983. Address: Clearwater.

Date of alleged crime: June 10, 2018.

Charges:

Count 1: Domestic battery, Class B misdemeanor.

Count 2: Disorderly conduct, Class C misdemeanor.

Case description: Fogle is accused of arguing with his mother which caused her husband to get involved and accelerate into a physical fight.

State of Kansas v. Ricky Lee Rodecap — Case No: 18 CR 175

Date of birth: 1978. Address: Haysville.

Date of alleged crime: July 3, 2018.

Charges:

Count 1: Theft of a motor vehicle, level 9 felony.

Case description: Rodecap is accused of stealing a 1999 Harley Davidson motorcycle when it was discovered in the Kansas Star Casino parking lot.

State of Kansas v. Tedral Towery — Case No: 18 CR 176

Date of birth: 1963. Address: Cedar Hill, Texas.

Date of alleged crime: March 31, 2018.

Charges:

Count 1: Failure to appear.

Case description: Towery is accused of not showing up for Sumner County District Court Case 16-395 for charges of possession of marijuana, possession of drug paraphernalia and DUI charges levied on Dec. 21, 2016.

State of Kansas v. Edward Glover — Case No: 18 CR 177

Date of birth: 1971. Address: Arkansas City.

Date of alleged crime: March 4, 2017.

Charges:

Count 1: Theft, level 9 felony.

Count 2: Burglary of non-dwelling, level 7 felony.

Case description: Glover is accused of stealing a large gold-plated chalice valued at $1,755, an Eucharist Penne and two smaller chalices valued at $475 each from St. Anthony’s Catholic Church stored inside a locked wooden cabinet. The large chalice was recovered at Gently Used Resale at 2523 S. Seneca in Wichita. The employee there allegedly told the police officer that a woman had come into the shop and donated the chalice and said it might be stolen. The employee said the story checked out to a theft at St. Anthony’s Catholic Church and they were storing it in the back room waiting for someone from the church to pick it up, but no one did so, until the police officer’s visit.

According to affidavit information on the complaint, the church door was open on March 4, 2017, and Glover went in while his friend Timothy Nash stood outside. Glover allegedly went in, broke into the cabinet and stole the items before storing it inside his jacket while walking out. Allegedly, Glover gave the two smaller chalices to Nash, who buried them in his yard. When apprehended, Nash dug up the smaller chalices but said the larger one was in Wichita.

State of Kansas v. Russell Rains — Case No: 18 CR 178

Date of birth: 1985. Address: Wellington.

Date of alleged crime: May 14, 2018.

Charges:

Count 1: Aggravated battery, level 4 felony.

Count 2: Aggravated battery, level 4 felony.

Count 3: Aggravated battery, level 7 felony.

Count 4: Aggravated domestic battery, level 7 felony.

Count 5: Aggravated kidnapping, level 1 felony.

Case description: Rains is accused of grabbing his father through the window of a white van, who was trying to escape by driving away from the residence. Allegedly, the father backed up the van about 50 feet and pulled forward 50 feet but could not escape Rains, who forcibly removed him from the van and threw him on the ground. Rains is then accused of punching his father 18 times and putting him in a choke hold until he became unconscious.

Then, allegedly, two people in a white pickup drove by and the hostilities stopped, and the father regained consciousness. Rains allegedly went back into the building leaving the father at the van. Then allegedly after the pickup left, Rains came back out of the building and punched his father five more times, knocking him unconscious for a second time before going back into the house a second time. 

After the father regained consciousness again, Rains came out a third time and allegedly slammed the driver’s door of the white van on his father. He then allegedly strangled the father with both hands around his neck, while the father’s back was against the white van, causing him to go unconscious for a third time.

State of Kansas v. Zebulon Charles Pike  — Case No: 18 CR 179

Date of birth: 1980. Address: Belle Plaine.

Date of alleged crime: July 8, 2018.

Charges:

Count 1: Criminal threat, level 9 felony.

Count 2: Domestic battery, Class B misdemeanor.

Count 3: Disorderly conduct, Class C misdemeanor.

Case description: Pike is accused of yelling, “I am going to kill you” to a Belle Plaine couple with a semi-automatic hand gun holstered on his right hip. Then allegedly, Gilliam pushed the woman to the ground and tried to grab the male.

State of Kansas v. Miguel Gutierrez, Jr.  — Case No: 18 CR 180

Date of birth: 1990. Address: Oklahoma City.

Date of alleged crime: July 6, 2018.

Charges:

Count 1: Unlawful distribution of heroin, level 1 drug felony.

Count 2: Speeding, infraction.

Case description: Gutierrez, Jr. is accused of distributing at least 100 grams of heroin found inside a black trash back inside electrical taped bundles about five inches long while driving a white Ford Edge on I-35 near mile post 29 in Sumner County while going 94 in a 75 mile-per-hour zone.

State of Kansas v. Seth Hull — Case No: 18 CR 181

Date of birth: 1987. Address: Wichita.

Date of alleged crime: June 28, 2018.

Charges:

Count 1: Domestic battery, Class B misdemeanor. 

Count 2: Disorderly conduct, Class C misdemeanor.

Case description: Hull is accused of angrily grabbing the leg of a woman hard enough to leave a bruise and calling her derogatory names while threatening to push her out of a car.

State of Kansas v. Daniel Johnson — Case No: 18 CR 182

Date of birth: 1960.  Address: Haysville.

Date of alleged crime: July 6, 2018.

Charges:

Count 1: Speeding, traffic infraction. 

Count 2: Possession drug paraphernalia, Class B misdemeanor.

Count 3: Possession cocaine, level 5 drug felony.

Count 4: Driving under the influence, second offense, prior conviction March 22, 2014.

Case description: Johnson is accused of driving in Belle Plaine at a speed of 47 mph in a 30 mph speed zone while possessing a glass pipe with crack cocaine and being under the influence.

State of Kansas v. Benjamin Martin — Case No: 18 CR 185

Date of birth: 1985.  Address: Oxford.

Date of alleged crime: June 24, 2018.

Charges:

Count 1: Possession of marijuana, Class B misdemeanor. 

Count 2: Possession drug paraphernalia, Class B misdemeanor.

Case description: Martin is accused of possessing a marijuana cigarette, an electronic cigarette loaded with marijuana and additional marijuana inside a pill bottle in the glove compartment of Justin Minor’s Ford Ranger pickup at the park in Oxford. He allegedly also had a grinder.

State of Kansas v. Justin Minor — Case No: 18 CR 186

Date of birth: 1982.  Address: Winfield.

Date of alleged crime: June 24, 2018.

Charges:

Count 1: Possession of marijuana, Class B misdemeanor.

Count 2: Possession drug paraphernalia, Class B misdemeanor.

Case description: Minor is accused of having a marijuana cigarette and an electronic cigarette loaded with marijuana inside a pill bottle in the glove compartment of the vehicle. Both Benjamin Martin and Minor were allegedly smoking marijuana while sitting inside Minor’s Ford Ranger pickup at the park in Oxford. He also allegedly also had a grinder, swisher rolling paper and an electronic smoking device.

State of Kansas v. Sherry Sanborn — Case No: 18 CR 188

Date of birth: 1967.  Address: Argonia.

Date of alleged crime: July 14, 2018.

Charges:

Count 1: Domestic Battery, Class B misdemeanor.

Count 2: Aggravated domestic battery, level 7 felony.

Count 3: Battery, Class B misdemeanor.

Count 4: Battery, Class B misdemeanor.

Count 5: Disorderly conduct, Class C misdemeanor.

Case description: Sanborn is accused while riding in a car between Caldwell and Argonia of grabbing the top of a head of a woman she was living with, pulling it back, and hitting her several times on her nose. She then allegedly, outside the vehicle, pinned the household member against a wall and put both of her hands on her throat. Allegedly, she then got on top of her and hit her repeatedly in a rude manner.

Sanborn is also accused of grabbing another woman and calling her a derogatory name.

State of Kansas v. Michael Saville — Case No: 18 CR 190

Date of birth: 1963.  Address: Winfield.

Date of alleged crime: May 24, 2018.

Charges:

Count 1: Burglary of a non-dwelling, level 7 felony.

Count 2: Theft, Class A misdemeanor.

Count 3: Burglary of dwelling, level 7 felony.

Count 4: Theft, Class A misdemeanor.

Count 5: Criminal damage to property, Class B misdemeanor.

Case description: Saville is accused of entering a storage building and stealing a table saw from a property, address not listed on the complaint. Then at 517 N. Seneca, Saville allegedly steals a 42-inch LG television, Samsung tablet, Kindle tablet, jewelry and other items. He also allegedly kicked in the door of the premises without the consent of the owner.

State of Kansas v. Justin Goans — Case No: 18 CR 191

Date of birth: 1992.  Address: Wellington.

Date of alleged crime: July 17, 2018.

Charges:

Count 1: Domestic battery, Class B misdemeanor.

Case description: Goan is accused, after running out of gas near 600 E. 40th Ave. near Wellington, of punching a girl in the face who he was having a dating relationship with causing her to get a black eye and other abrasions and bruises.

Date of alleged crime: July 19, 2018.

Charges:

Count 1A: Rape, level 1 felony.

Count 1B: Rape, level 1 felony.

Count 2: Aggravated criminal sodomy, level 1 felony.

Count 3A: Aggravated sexual battery, level 5 felony.

Count 3B: Aggravated sexual battery, level 5 felony.

Case description: Roberson is accused of having sexual intercourse with a woman who told him no, and/or was allegedly too intoxicated at the time to give consent.

State of Kansas v. Savanna Hamilton — Case No: 18 CR 193

Date of birth: 1998.  Address: Wichita.

Date of alleged crime: July 21, 2018.

Charges:

Count 1: Possession of Hallucinogenic Drug, Class A misdemeanor.

Count 2: Possession of drug paraphernalia, Class B misdemeanor.

Case description: Hamilton is accused of possessing two ecstasy pills contained in a purple bag.

State of Kansas v. Joseph Jackson — Case No: 18 CR 194

Date of birth: 1978.  Address: Wellington.

Date of alleged crime: July 16, 2018.

Charges:

Count 1: Robbery, level 5 felony.

Count 2: Theft, Class A misdemeanor.

Case description: Jackson is accused of taking cigarette cartons and $492 in cash from Jumpstart gas station in Wellington while implying threat of bodily harm to the cashier at the time of the alleged crime. Jackson was wearing a black bandana with possibly a skull on it wrapped around the lower portion of his face, black sunglasses and another bandana wrapped around his head, and was wearing all black when the cashier had come out of the bathroom.

Allegedly, Jackson yelled to the cashier to “open the f—- register.” When the cashier didn’t comply, Jackson allegedly yelled at him again and to “hurry the F up.” According to the complaint, the cashier opened the register because he did not want to get beat up or killed over “ a little bit of money.”

Allegedly, Jackson took $80 of cigarette cartons, $442 in cash from the register, and a $50 money roll from the safe. He also took a telephone.

State of Kansas v. Toy Martin — Case No: 18 CR 197

Date of birth: 1982.  Address: Arkansas City.

Date of alleged crime: July 25, 2018.

Charges:

Count 1: Aggravated kidnapping, level 1 felony.

Count 2: Aggravated domestic battery, level 7 felony.

Count 3: Battery, Class B misdemeanor.

Case description: Martin is accused of going to a neighbor’s house in Geuda Springs, grabbing his girlfriend by the hair and pulling her back to her home. He then allegedly pulled her inside, threw her on the ground and grabbed her by the hair and throat causing bruises to her neck. He also allegedly impeded the normal breathing and circulation of blood in her neck by applying pressure to the throat and then angrily pushing away another person who was trying to step between him and her.

Charges:

Count 1: Burglary of non-dwelling, level 7 felony.

Case description: Brill is accused of stealing a truck and trailer that was being stored in a barn.

Case description: Holland is accused of smoking marijuana at 217 South F after an officer was returning two pit bulls which were running at large and asking about the marijuana smell coming from the house. Holland also allegedly possessed a marijuana pipe and rolling papers.

Case description: Gressel is accused of sending a text message from a home accusing a girl of having an affair, then sending a photo of a handgun and then a third text saying he was going to shoot her.

Date of birth: 1988.  Address: Caldwell.

Date of alleged crime: July 22, 2018

Charges:

Count 1: Possession methamphetamine, level 5 drug felony.

Count 2: Possession drug paraphernalia.

Case description: Gressel is accused of using meth before the police arrived and still had a small quantity of meth on a spoon in a plastic bag in his pocket when he was arrested on an active arrest warrant.
