Bryar Moore of Wellington faces court deposition in aggravated battery case
by Tracy McCue, Sumner Newscow — Bryar Moore, 23, of Wellington is schedule for a deposition in Sumner County District Court on July 13, stemming from charges of aggravated battery, a level 7 felony.
The charge stems from a physical confrontation involving Moore and a male subject outside the Casey’s West convenience store in Wellington on Saturday, May 20 at 6:43 p.m.
According to a redacted court affidavit, released by Sumner County District Court upon the request of Sumner Newscow, the male subject was treated and released from Sumner Regional Medical Center for a concussion and a displaced nose fracture.
Allegedly, Moore hit the male at least three times — once when he was standing and twice or more when he was on the ground unconscious. The alleged victim told police he does not remember the incident, and his last memory was approaching the Casey’s West store.
According to the affidavit, Moore and a friend was driving to Casey’s West after playing a round of golf. Moore allegedly told police officers that he was in good spirits after winning $60 in golf. After purchasing items in the convenience store, Moore and his friend left the store where a man was leaning on a glass window smoking a cigarette, according to witness interviews.
Moore told police he did not know the man but playfully poked him in the chest saying “hey, what’s that?” as a way of trying to be funny. Allegedly, the man took offense to it and the two began to verbally spar. In the affidavit, surveillance footage from Casey’s shows that Moore eventually hit the subject, causing him to fall backwards into the glass window and down on the ground. Moore then allegedly hits the male a couple or more times. Both Moore and the male friend left in a silver Lexus vehicle while the victim was unconscious, according to the affidavit.
Video surveillance also shows that the friend had tried to get Moore to leave before the alleged battery took place. Moore was later found at his home, and allegedly, according to the report, he denied the incident took place, but then confessed thereafter.
He was arrested at 7:03 p.m. at the Wellington Police Department and Judge Scott McQuin set a $15,000 bond, for which Moore posted and was released from Sumner County jail.
According to the affidavit, there was only one person other than the friend, who witnessed the alleged battery and that was a 7-year-old boy who was in a nearby vehicle while his dad was pumping fuel.
Sumner County Attorney Kerwin Spencer said aggravated battery carries a stiffer penalty than aggravated assault because actual contact of a victim was made. He did not know how far the case will proceed as it is very early in the process or if Moore will receive any jail time.
