You may expunge or erase your criminal record for a flat fee of $400 for each Sumner County District Court case or $280 for each Wellington Municipal Court case.  Both amounts include the filing fees.  Convictions or arrests may be eligible.  All cases must be paid for by March 31, 2016 to be eligible for this flat rate.

You must have no criminal convictions for at least three to five years following the end of your probation or parole and meet other statutory eligibility requirements.  If non-eligibility can be determined without research, there will be no charge.  If research is needed to determine what you were arrested for or convicted of OR when your probation or parole period ended AND you are determined to be NOT eligible for filing for an expungement, there will be a $70 charge and the remainder will be refunded to you.  Therefore, bring any documentation you may have when you see the attorney.  Once the motion is filed, no money will be refunded, regardless of the outcome.

An expungement will block your conviction or arrest from certain employers and others as allowed by statute, however it does not totally erase your record.

Filing does not guarantee an expungement, but your case will be brought before the judge for him to decide whether an expungement should be granted.  Other restrictions may apply.
