Recent Sumner County Court Docket…

by Tracy McCue, Sumner Newscow — The following are two lists coming from the Sumner County District Court office.

The first list is “Court Complaint Filings” which are criminal court complaints recently filed by the Sumner County Attorney’s office. The suspects listed in the complaint list have not been tried by a judge or jury. All citizens are innocent until proven guilty in a court of law.

The second list is the “Convictions by Degree” which are cases where a verdict has been rendered by a Sumner County judge or jury.

Court Complaint Filings: 

Tyler Gross, born in 1994, of Clearwater was charged with possession of marijuana, a Class A misdemeanor; and possession of drug paraphernalia, a Class A Misdemeanor. The case has been continued to May 23, 2013.

Joshua Kittrell, born in 1981, of Wichita, was charged with driving while license was suspended or revoked; two counts of transporting an open container, and theft of under $1,000. All charges are misdemeanors.

Kittrell is accused on April 15 of driving a motor vehicle while unauthorized to do so, while transporting two alcoholic beverages. He is then accused of stealing pieces of scrap metal valued under $1,000.

At the same time, Vernon Turpin, born in 1982, of Wichita was charged with two counts transporting an open container, and theft under $1,000 – all misdemeanors.

Dale Jorgensen, born in 1961, of Wichita was charged with battery, a Class B Misdemeanor; and disorderly conduct, a Class C Misdemeanor.

Jorgensen is accused of punching another person, Franklin Keller, in the face during an argument at the jail. Keller allegedly told Jorgensen he needed to take a shower which started the argument.

Steven Arebalo, born in 1981, of Wellington was charged with lewd and lascivious behavior, a Level 9 person felony; aggravated indecent liberties with a child; a level 3 person felony; and aggravated indecent liberties with a child, a level 3 person felony.

Michael Richardson, born in 1965, of Belle Plaine was charged with aggravated assault of a law enforcement officer, a Level 6 person felony; DUI – a third offense, a nonperson felony; fleeing a police officer, a level 9 person felony; obstructing official duty by resisting arrest, a level 9 non-person felony; and aggravated battery of law enforcement officer, a level 4 person felony.

According to the complaint, on April 19, 2013 a law enforcement officer responded to a report that Richardson was intoxicated and was driving on the victim’s property in circles. The Sumner County Sheriff deputy parked his patrol vehicle on the property and activated his emergency lights. Richardson allegedly tried to ram his vehicle into the deputy patrol car. The deputy had to move his vehicle to narrowly avoid being struck broadside.

Then Richardson allegedly drove off in the motor vehicle willfully fleeing or attempting to elude the pursing deputy’s police vehicle despite being given visual or audible signals to bring the vehicle to a stop.

During the pursuit, Richardson allegedly drove in a reckless manner. In the complaint, Richardson allegedly repeatedly tried to ram the deputy’s vehicle before stopping his car and fleeing on foot. Once apprehended he physically assaulted another officer’s attempt to handcuff him, the complaint said.

Richardson, then, allegedly spit on another officer. The complaint said Richardson has Hepatitis C.

Richardson was tested and allegedly had an alcohol concentration in his blood level to be .08 or more within the three hours he was operating the vehicle.

Jacob Gray, born in 1991, of Wellington has been charged with possession of narcotic drug, a level 5 drug felony; possession of marijuana, a Class A misdemeanor; and possession of drug paraphernalia, a class A misdemeanor.

Larry Gormly, born in 1973, of Belle Plaine was charged with criminal damage to property, a class B misdemeanor; disorderly conduct, a class C misdemeanor; criminal threat, a level 9 felony; kidnapping, a level 3 person felony; and domestic battery, a class B misdemeanor.

Gormly is accused of assaulting a family member on April 22, 2013. He first allegedly flipped a coffee table valued less than $1,000 which the alleged victim had interest in and called the woman various abusive names in hopes of provoking her.

The alleged victim then ran outside in hopes of escaping the situation. According to the complaint, Gormly then allegedly told the alleged victim “she should come back inside and if the cops showed up he would beat her so she was unrecognizable.”

The victim allegedly would talk to her mother on the phone and went back inside the residence where another argument developed. Gormly then allegedly held the alleged victim down to inflict bodily injury or terrorize her. When she tried to again leave the residence out of fear of what he would do, he grabbed her and forcefully pulled her back into the residence and slammed the door, knocking her down and pinning her to the floor and punching her, according to the complaint.

He then is accused of kicking her after pushing her to the ground.

Brendan Auzat, born in 1989, of Wellington; and Miguel Ibanez, born in 1985, of Wellington were charged with theft, a class A misdemeanor; unlawful use of financial card, a class A misdemeanor; identity theft, a class 8 non-person felony; identity fraud, a level 8 nonperson felony; and obstruction official duty, a class A misdemeanor.

According to the complaint, at about 11:30 a.m. on Feb. 27 at 401 Circle, Apt. #3, Auzat and Ibanez obtained a wallet containing credit cards, $6 in cash, 16 Xanex pills and cell phone from someone else.

Then allegedly on March 1, 2013 about 1 a.m. at the Security State Bank ATM they used the financial card of the alleged victim without his consent. Auzat and Ibanez allegedly withdrew $600 cash from the card.

Auzat is then accused of obtaining the alleged victim’s personal identifying information with his social security card and vision card containing account numbers and PIN numbers.

Auzat and Ibanez then allegedly altered and amended the PIN number on the vision card so they could use the new number to withdraw cash from the account. Auzat then is accused in obstructing the investigation by falsely identifying “Marcus” as the person giving him the ATM card when his real name was Miguel Ibanez.

Enrique Urbina, born in 1989, of Belle Plaine was charged with two counts of battery, a class B misdemeanors; and interference with a law enforcement, a class A misdemeanor.

According to the complaint, on April 13, Urbina was intoxicated and became upset with a guitarist Benjamine Gooch because he would not play a song by Johnny Cash and spit beer on him. Then allegedly Urbina pushed another musician Kenny Gooch after he asked Urbina to leave the party and escorting him out the door.

Allegedly, Urbina would then physically resist arrest while being handcuffed by a Belle Plaine police officer.

Jared Lane, born in 1973, of Ponca City, Okla. was charged with possession of methamphetamine, a level 5 drug felony; possession of drug paraphernalia, a class A misdemeanor; driving while suspended or revoked, class A misdemeanor; and failure to provide proof of insurance, a class B misdemeanor.

Willie Jacobs, born in 1963, of Wichita, was charged with aggravated battery, a Level 8 felony.

According to the complaint, Jacobs angrily punched a victim several times causing him to hit his head against a metal beam causing severe bleeding.

Kendra Lea Ginn, born in 1981, of Caldwell, was charged with domestic battery, a class B misdemeanor; and disorderly conduct, a class C misdemeanor.

Ginn is accused of punching and biting a family member during an argument and using fighting words.

Melissa Stewart, born in 1974, of Wellington was charged with violation of extended stalking order, a level 6 felony; criminal damage to property, a class B misdemeanor; and battery, a class B misdemeanor.

Stewart is accused of violating a protection from stalking order that was extended from Feb. 13, 2013 to Feb. 8, 2014. She allegedly violated the order on April 16, 2013 by coming onto a property on North B in Wellington of the person she was ordered not to stalk. Stewart allegedly refused to leave as instructed and then tried to steal a license tag decal sticker off the alleged victims vehicle before grabbing and pushing her to the ground.

Douglas Duerksen, born in 1993, of Belle Plaine, was charged with possession of marijuana, a Class A misdemeanor; possession of drug paraphernalia, also a class A misdemeanor.

Alexander Austin-Sharif Kheir, born in 1991, of Bristow, Okla. was charged with a traffic infraction, driving while suspended, a class B misdemeanor; possession of marijuana, a class A misdemeanor; possession of drug paraphernalia, a class A misdemeanor.

Austin-Sharif Kheir was accused of driving on I-35 in Sumner County 12 miles per hour over the speed limit while license was suspended and possessing marijuana and drug paraphernalia.

Ronald Erber, 61, of Wellington was charged with aggravated assault, a level 7 felony; criminal damage to property, a class A misdemeanor; aggravated battery, a level 8 felony and criminal threat, a level 9 felony.

Thornton Rayl, 46, of Wellington was charged with aggravated battery, a level 7 felony; and simple battery, a Class B misdemeanor.

According to the complaint, around 11 p.m. on April 24, Erber is accused of going to Rayl’s house with a machete and demanding payment for an earlier service and when Rayl claimed not to owe any money, Erber swung the machete in a menacing manner causing Rayl to retreat inside his house and shut the storm door.

Erber is then accused of using the machete to break the glass on the front storm door, valued less than $1,000.

Allegedly, Erber then caused bodily harm to a second person in the home by swinging the machete at both residence and recklessly cutting the second person and causing a minor scratch.

Erber then allegedly threatened to kill Rayl, who told Erber that there were babies sleeping and he needed to get off his property. Allegedly, Erber replied he didn’t care about the kids and he was going to kill Rayl.

Rayl is accused of using a baseball bat by pursuing Erber after he had been disarmed and was trying to leave, by hitting him in the back with the bat.

Allegedly, after Erber was knocked to the ground and was trying to leave, Rayl dropped the bat and punched and kicked Erber in the head.

Zach Deffenbaugh, born in 1991, of Wellington, was charged with possession of methamphetamine, a level 4 drug felony; possession of drug paraphernalia, a class A misdemeanor; and obstruction of official duty, of class A misdemeanor.

On April 27, Deffenbaugh is accused of obstructing a Wellington police officer during an investigation of him allegedly having meth or drug paraphernalia.

Derrick Buford Shamblin, born in 1987, of Oxford was charged with rape, a level 1 felony; aggravated sexual battery, a level 5 felony; and adultery, a class C misdemeanor.

Shamblin is accused of knowingly engaging in sexual intercourse with a victim, who did not consent and was unconscious or powerless. Allegedly, the alleged victim went to sleep on the couch after consuming alcohol and playing cards and awoke later with Shamblin having sex with her, the complaint said.

Shamblin is also accused of engaging in sexual intercourse with someone he is not married to and he was married at the time to someone else.

Colby Grant Pepper, born in 1993, of Wellington was charged with possession of marijuana with intent to sell, a level 4 drug felony; two counts of possession of drug paraphernalia, a level 5 drug felony; and possession of marijuana, class A misdemeanor.

Justin Ray Osborne, born in 1990, of Wellington was charged with unlawfully hosting minors consuming alcoholic liquor, a class A misdemeanor; furnishing alcoholic liquor to underage adults, a Class B misdemeanor; and aggravated sexual battery, a level 5 person felony; and rape, a level 1 person felony.

According to the complaint, from 8 p.m. to 12 a.m. on April 27 Osborne is accused of permitting people under 21 years of age to a party at his residence at 1315 North B and providing whisky and brandy that was consumed by three underaged individuals.

Then, allegedly, at 4 a.m. Osborne is accused of inappropriately touching a victim who is 16 years or more and having sexual intercourse when the victim was unconscious or physically powerless because she was asleep and passed out due to the consumption of alcohol.

Michael Row, born in 1988, of Wellington was charged with possession of marijuana with intent to sell, a level 4 drug felony; possession of drug paraphernalia, a level 5 drug felony; possession of drug paraphernalia, a Class A misdemeanor; and possession of marijuana, a class A misdemeanor.

Seth Helton, born in 1992, of Wellington was charged with furnishing alcoholic liquor to an underage adult, a class B misdemeanor; unlawfully hosting minors consuming alcoholic liquor or cereal malt beverage, a class A misdemeanor; and purchase or consumption of alcoholic liquor by minor, a class C misdemeanor.

Helton is accused on April 26 of furnishing beer to three people under 21 years of age at his residence on 1207 South C in Wellington and unlawfully hosting a party while being under 21.

Rachel Reed, born in 1985, of Belle Plaine was charged with DUI, a Class B misdemeanor, refusal of preliminary screening test for alcohol concentration; driving left of center; possession of drug paraphernalia, a class A misdemeanor; possession of marijuana, a class A misdemeanor; and traffic in contraband in a correctional institution.

According to the report, Reed was stopped on April 27 after driving left of center. She allegedly refused to take a preliminary screening test for alcohol content. After eventually getting tested, the complaint said Reed had a blood alcohol content of .08 or more.

She also allegedly had a blue pipe with intent to use or ingest a controlled substance. The complaint also said Reed “feloniously and intentionally attempted to introduce a controlled substance, i.e. marijuana, upon the grounds of a correctional institution without the consent of the administrator of the correctional institution.”

Kelsey Garmon, born in 1992, of Argonia was charged with two counts of identity fraud, level 8 non-person felonies.

Garmon allegedly falsely claimed she was another person using that person’s temporary driver’s license identifying her as such at the Kansas Star Casino.

She then allegedly drew a check on that person’s account at Security State Bank in Wellington. Garmon possessed the check intending to present it on her own account.

Ashley Pearson, born in 1989, in Wellington was charged with criminal trespass, a Class B misdemeanor; and aggravated assault, a level 7 felony.

According to the complaint, Pearson entered in an apartment at 1320 Michigan without permission and remained there even after the person living there told her to leave.

Pearson is also accused of attacking the resident with a frying pan.

Trevor Smith, born in 1973, of Wellington was charged with disorderly conduct, a Class C misdemeanor; and violation of protective order, a class A misdemeanor.

According to the complaint, Smith aroused and alarmed others in a verbal argument on April 30, 2013 with Cindy Osteen, born in 1974, of Wellington who he was not to have direct or indirect contact with according to a protective order.

Osteen was also charged with disorderly conduct and criminal trespass, a class B misdemeanor. She had entered land in Oxford knowing she was not authorized or privileged to do so in defiance of an order not to enter said premises.

Eugene McCormick, born in 1992, of Washington was charged with possession of drug paraphernalia, a Class A misdemeanor; and interference with law enforcement.

In the complaint, McCormick had a small glass smoking pipe in his possession. When a Wellington police officer said he was under arrest, McCormick allegedly ran from his yard into his house, which resulted in the police officer having to run after him and catching him in the house.
