Sumner County Court Docket: Feb. 26, 2014 report

by Tracy McCue, Sumner Newscow — The following are a list of criminal court complaints recently filed by the Sumner County Attorney’s office.

These are formal charges introduced into the Sumner County District Court system. The suspects listed in the complaint have not been tried by a judge or jury. All citizens are innocent until proven guilty in a court of law.

Jonas Avila, born in 1988, of Wichita was charged with possession of marijuana, a Class A misdemeanor; possession of drug paraphernalia, a Class A misdemeanor, and speeding, a traffic infraction.

Avila is accused of having loose marijuana inside two bottles of Everclear in his motor vehicle after being pulled over for speeding 88 mph in a 75 mph zone on Feb. 3, 2014

Bradley McPhee, born in 1980, of Braman, Okla. was charged with aggravated burglary, a level 5 felony; and criminal damage to property, a Class B misdemeanor.

McPhee is accused of on Feb. 8, 2014, entering a building at 906 N. Broadway in Belle Plaine to commit a crime when the owners were present. He allegedly destroyed the back door and door frame when trying to break in causing about $600 damage.

Colton O’Neal, born in 1992, of Arkansas City was charged with unlawful use of driver’s license, a Class A misdemeanor; interference with law enforcement, a Class A misdemeanor; and possession of methamphetamine, a level 5 drug felony.

On Feb. 9, 2014, O’Neal was accused of using a driver’s license of another person at the Kansas Star Casino. When asked by an agent, O’Neal allegedly falsely claimed he was that person on the driver’s license. He also allegedly had several clear plastic baggies containing methamphetamine in the pocket of his hooded sweatshirt when he was being arrested.

Charlie Riggs of Peck was charged with driving under the influence, his fourth offense in a lifetime, a felony, which requires a mandatory 90 days in jail. He had previous DUI convictions from Sumner County District Court in 2012, Clearwater Municipal Court in 2003, and Sumner County District Court in 2002.

Amy Squires, born in 1975, of Wellington was charged with defective tail lamp, traffic infraction; driving under the influence, a Class B misdemeanor; and interference with law enforcement, a Class A misdemeanor.

Squires was stopped on U.S. 160 on Feb. 2, 2004 with a detective tail lamps between sunset and sunrise. She allegedly could not safely operate a motor vehicle while having a blood alcohol content of .08 percent or above as mentioned within three hours of operating the vehicle. She then is accused of physically resisting being arrested and handcuffed for DUI by trying to flee on foot then resisted being handcuffed when she was caught.

Caleb Stewart, born in 1987, of Wellington was charged with theft, a Class A misdemeanor; burglary, a level 7 felony; theft, Class A misdemeanor; and interference with law enforcement, a level 9 felony.

Stewart is accused on Jan. 3, 2014 of taking $40 in cash from someone’s purse while she was in the bathroom. He also allegedly climbed through the window and removed a Sanyo Flat screen television and casebook CDs and DVDs from the house without the owner’s permission.

After being apprehended, Stewart allegedly initially falsely claimed he had not entered the residence through the window and taken the television, even though he is accused of pawning the TV. He then allegedly changed his story after being confronted with tracks left by his shoes below the bathroom window.

Douglas Green, Jr., born in 1976, of Conway Springs was charged with domestic battery, a Class B misdemeanor.

Green is accused of on Feb. 11, 2014 grabbing a household member during an argument.

His court deposition is Feb. 27.

Larry Stewart, born in 1982, of Wichita was charged with theft, a level 7 felony.

Stewart is accused on Feb. 13, 2014, of unlawfully obtaining control over a 2012 Chevrolet Tahoe with 4-wheel drive to deprive the owner, Larry Both and Murphy Tractor and Equipment Co., permanently of the possession.

Stewart allegedly stole the car from the Valet parking line at the Kansas Star Casino and drove it away without permission.

His deposition is Feb. 27.

Tracy Ward, born in 1964, of Argonia was charged with battery, a Class B misdemeanor; criminal threat, a level 9 felony; and criminal damage, a Class B misdemeanor.

Ward is accused on Feb. 18, 2014 of repeatedly punching and kicking another person. He also was accused of threatening this same person that if he called the police, Ward would kill him and his dog.

He then allegedly damaged a lamp and a coffee table.

 

COURT UPDATES: 

The following is a convictions and dismissals of Sumner County District court cases where a verdict has been rendered by a Sumner County judge or jury.

•Paul Osborne, Jr. born in 1981, of Wellington pled guilty to two counts of Drug 4 felonies on Jan. 24, 2014. Four other drug felony drug charges were dismissed.

•Tyron James, born in 1981, of Wichita pled guilty to forgery; distribution or issuing a written instrument, a level 8 felony. He was accused of paying for merchandise worth $342.18 at Wellington O’Reilly’s by purporting to be another person.

•Gregory Norris, born in 1975, of Blackwell, Okla. pled guilty to forgery, a level 8 felony on Feb. 6, 2014. Norris was accused of altering checks.

•Kanisha Hamilton, born in 1988, of Oklahoma City pled guilty to battery of a law enforcement officer, a Class A misdemeanor. Two felony counts were dismissed. She was accused of assaulting a police officer.

•Ronnie Bryant, born in 1953, of Topeka, fourth DUI offense was dismissed. He pled guilty to driving while being a habitual violator, a Class A misdemeanor, and tampering with ignition interlock device.

•Robert Vandyke, born in 1948, of Derby pled guilty to theft of property, an unclassified felony. Vandyke was accused of taking $85 from a dropped wallet at the Kansas Star Casino.

•Michael Ark, born in 1953, of Wichita pled guilty to theft, a Class A misdemeanor. He was accused of playing someone else’s voucher at the Kansas Star Casino.

On the following misdemeanor charges:

•Brittany Lenees Myers pled guilty to driving while license was cancelled/suspended.

•Matthew Kibler pled guilty to use/possession of drug paraphernalia with intent to introduce controlled substance into body, a Class A misdemeanor.

•Greggory Norris, theft of property less than $1,000 misdemeanor charge was dismissed.

•John Noyes pled guilty to use/possession of drug paraphernalia with intent to introduce controlled substance into body, a Class A misdemeanor and driving under the influence, a Class B misdemeanor.

•Mark Alan Gregg pled guilty to possession of certain depressants, a Class A misdemeanor.

•Thornton Lee Rayl misdemeanor charges for use/possession of drug paraphernalia with intent to introduce controlled substance into body, a Class A misdemeanor; and required liability insurance was dismissed.

•William Townsend misdemeanor charges for use/possession of drug paraphernalia with intent to introduce controlled substance into body, and possession of certain hallucinogenic drugs were dismissed.

•Michael Wayne Turner pled guilty to disorderly conduct, a Class C misdemeanor.

•Susieanna Cooper pled guilty to disorderly conduct for brawling or fighting, a Class C misdemeanor.

•Desiree Maxfield pled guilty to disorderly conduct, fighting words or noisy conduct to cause resentment, a Class C misdemeanor.

•John Dee Brown pled guilty to assault, a Class C assault misdemeanor charge.

•David Gressel pled guilty to disorderly conduct, fighting words or noisy conduct to cause resentment, a Class C misdemeanor.
