Sumner County Court Docket: June 24, 2015 report

These are formal charges introduced into the Sumner County District Court system. The suspects listed in the complaint have not been tried by a judge or jury unless specified otherwise. All citizens are innocent until proven guilty in a court of law.

State of Kansas v. Thaddeus Popplewell— Case No: 15 CR 134.
Date of birth: 1979 Address: Caldwell.
Charges:
Count 1 – Violation of Protective Order, Class A misdemeanor.
Count 2 – Criminal Trespass, Class B misdemeanor.
Date of alleged crime: May 21, 2015.
Case description: Popplewell is accused of entering a residence for which he had a restraining order preventing him from entering.

State of Kansas v. Daniel Lewis Weitzel — Case No: 15 CR 135.
Date of birth: 1969 Address: Caldwell.
Charges:
Count 1 – Aggravated burglary – level 5 felony.
Count 2 – Aggravated battery – (No level listed)
Count 3 – Criminal threat – level 9 felony.
Date of alleged crime: May 24, 2015.
Case description: Weitzel is accused of going to a dwelling in Caldwell uninvited between 4 and 4:25 a.m. intending to cause great bodily harm to a person who lives there. Weitzel allegedly physically attacked a person who emerged from his bedroom to investigate noises caused by Weitzel who entered the home without his permission.
Weitzel also is accused of overpowering the alleged victim by kicking him and repeatedly punching him in the head, causing a concussion and significant bleeding and rib injuries.
Allegedly, after Weitzel was taken to Sumner County Jail and during the booking process he told the officer in charge he was going to kill him. When the officer in charge asked if Weitzel wanted another charge and other deputies told him to stop making threats, Weitzel made hand gestures indicating he was going to kill the officer.

State of Kansas v. Monica Sharkey — Case No: 15 CR 136.

Count 1 – Possession marijuana, Class A misdemeanor.
Count 2 – Possession drug paraphernalia, Class A misdemeanor.
Date of alleged crime: May 24, 2015.
Case description: Sharkey is accused of having a small quantity of marijuana in her marijuana pipe in a motel room in Wellington.

State of Kansas v. Tina Weidner — Case No: 15 CR 137.

Charges:
Count 1 – Assault, Class C misdemeanor.
Count 2 – Criminal damage to property, Class B misdemeanor.
Count 3 – Disorderly Conduct, Class C misdemeanor.
Count 4 – Interference with law enforcement, Class A misdemeanor.
Date of alleged crime: May 30, 2015
Case description: Weidner is accused of approaching another woman with her fists and threatening to punch her. She then allegedly by means other than fire or explosives substantially damage furniture, laundry and dishes by throwing several items throughout the house in the trash and breaking a drinking glass. The damage was less than $1,000.
She also allegedly resisted arrest while being handcuffed.

State of Kansas v. Curtis Wade Callaway — Case No: 15 CR 138.

Count 1 – Aggravated assault, level 7 felony.
Count 2 – Disorderly conduct, Class C misdemeanor.
Date of alleged crime: May 27, 2015.
Case description: Callaway is accused of placing another person in reasonable apprehension when he jumped out of a car window while brandishing a tire iron indicating he wanted to fight him. Callaway allegedly used profanity and invited said person to a fight while on the alleged victim’s property.

Count 1 – Driving under the influence – third offense (mandatory 90 day in jail with mandatory minimum fine of $1,750.
Count 2 – Driving while suspended or revoked, first offense, Class B misdemeanor.
Count 3 – Refusal of PBT, traffic infraction.
Count 4 – Speeding, traffic infraction.
Date of alleged crime: June 1, 2015.
Case description: Edwards is accused of having blood alcohol concentration in his blood being .08 or more while operating a vehicle.

State of Kansas v. Walter Jackson — Case No: 15 CR 140.
Date of birth: 1978 Address: Jess Dunn Correctional Center in Taft, Okla. formerly of Ponca City.
Charges:
Count 1 – Aggravated failure to appear, Level 10 felony.
Date of alleged crime: August 14, 2014.
Case description: On July 1, 2014, Jackson pled guilty to criminal damage to property charge on August 9, 2013 in Sumner County after damaging a car wash and incurring more than $1,000 damage. He allegedly skipped bond during his sentencing hearing on August 14, 2014, and failed to turn himself in within 30 days. He was subsequently arrested in Oklahoma County on Oct. 3, 2014 and remains in the custody of the Oklahoma Department of Corrections.

State of Kansas v. Robert Durham — Case No: 15 CR 141.
Date of birth: 1964 Address: Wichita.
Charges:
Count 1 – DUI – 4th offense, nonperson felony.
Count 2 – Transportation of open container, misdemeanor.
Count 3 – Refusal preliminary breath test.
Date of alleged crime: April 29, 2015.
Case description: Durham is accused of driving a vehicle on 18th St. in Wellington while under the influence of alcohol to a degree that rendered him incapable of safely driving a motor vehicle with unopened bottles of Bud Light. He was convicted in Sedgwick County for DUI in 2005.

State of Kansas v. Brenda Goodman — Case No: 15 CR 143.
Date of birth: 1959 Address: Wellington.
Charges:
Twelve counts – Mistreatment of a dependent adult, level 7 felony.
Eight counts – Mistreatment of a dependent adult, Class A misdemeanor.
Two counts – Intimidation of a witness, Class B misdemeanor.
Date of alleged crime: June 26, 2009 – April 11, 2014
Case description: Goodman is accused of feloniously taking advantage of dependent adults from resident trust accounts at Golden Living Center, by the use of deception, false pretense, and/or false representation for the dependent’s personal and financial advantage. She allegedly took advantage of the following people:

Goodman is also accused twice of attempting to dissuade a person from making a complaint to authorities.
Her bond was set at $20,000 and later reduced to $10,000 with conditions that she is to have no contact with anyone over the age of 70. The case has been continued to July 2 at 1:30 p.m.

State of Kansas v. Brent Berens — Case No: 15 CR 144.

Count 1 – Possession drug paraphernalia, Class A misdemeanor.
Date of alleged crime: May 19, 2015.
Case description: Berens is accused of possessing a spoon, syringes, and baggies which he acknowledged he had used with methamphetamine after he was intercepted for trying to remove a stereo belonging to his mother from a vehicle in a parking lot.

State of Kansas v. Christopher Schroeder— Case No: 15 CR 145.

Charges:
Count 1 – Possession methamphetamine, level 5 drug felony.
Count 2 – Possession drug paraphernalia, Class A misdemeanor.
Date of alleged crime: May 12, 2015.
Case description: Schroeder is accused of possessing narcotic drugs and having methamphetamine in luggage that was left with the attendant at the Hampton Inn at the Kansas Star Casino. He also allegedly had two glass methamphetamine pipes in his black shaving bag which he left with the attendant at the Hampton Inn.

State of Kansas v. Levi Wykes — Case No: 15 CR 146.
Date of birth: 1981 Address: Conway Springs.
Charges:
Count 1 – Aggravated assault, level 7 felony.
Count 2 – Domestic battery, Class B misdemeanor.
Date of alleged crime: May 29, 2015.
Case description: Wykes is accused during an argument of picking up a hatchet and threatening to kill another person before chasing her from the bedroom with the hatchet as she ran away in fear.
Allegedly, Wykes also angrily grabbed the woman multiple times with sufficient force to leave multiple bruises on her which were observed by law enforcement officers.

State of Kansas v. Brandon Fletcher — Case No: 15 CR 147.
Date of birth: 1994 Address: Wellington.
Charges:
Count 1 – Sale of marijuana, level 4 drug felony.
Count 2 – Use communication facility to facilitate drug sale.
Date of alleged crime: August 11, 2014.
Case description: Fletcher delivered about 8.9 grams of marijuana to an undercover law enforcement officer in return for $50 cash after he sent and received text messages to arrange the sale.

State of Kansas v. Kevin Kollmorgen — Case No: 15 CR 149.

Count 1 – Theft, Class A misdemeanor.
Count 2 – Battery, Class B misdemeanor.
Count 3 – Possession drug paraphernalia, Class A misdemeanor.
Date of alleged crime: June 2, 2015.
Case description: Kollmorgen is accused of taking a six gallon shop vac, jumper cables, and power washer with intent of selling those items to a pawn shop without owner’s permission.
He then is accused of angrily pushing a woman. Allegedly, when apprehended, he also had a metal marijuana pipe with pink hooks.

State of Kansas v. Parker Messamore— Case No: 15 CR 150.

Charges:
Count 1 – Failure to pay toll, misdemeanor.
Count 2 – Speeding 90 in 75 mph zone, traffic infraction.
Count 3 – Driving while suspended or revoked, second of subsequent offense.
Count 4 – Possession of marijuana, second of offense, drug felony.
Count 5 – Possession drug paraphernalia, Class A misdemeanor.
Count 6 – Interference with law enforcement, level 9 felony.
Date of alleged crime: June 5, 2015.
Case description: Messamore is accused of driving a vehicle on the Kansas Turnpike and did not pay in full paying $1.07 for the required toll of $1.60. After being stopped for going 90 mph in 75 mph zone, Messimore allegedly had marijuana in an orange pill bottle in the center cup holder in his 2015 Kia.
